Can I stay overnight in a supermarket car park?

Private land, so it is the owner's decision and enforcement is by parking charge rather than penalty. What the time limits mean, how ANPR works, and the Scotland difference nobody mentions.

Usually not without a charge, and it is a contract rather than a law. Supermarket car parks are private land. The owner sets the terms on the sign, and staying beyond them triggers a parking charge from a private company — not a penalty from a council.


What actually governs it

The sign is the contract. Drive in and you accept it. Typical terms:

Overstay and you get a parking charge notice — deliberately styled to resemble a council penalty, but legally a claim for breach of contract. Typically £60–£100, reduced for early payment.

The Scotland difference

Worth knowing, because almost nobody mentions it.

In England and Wales, the Protection of Freedoms Act 2012 lets a private operator pursue the registered keeper when the driver cannot be identified — provided they follow strict procedural rules.

In Scotland, POFA does not apply. Keeper liability is not available in the same way, so the operator can generally only pursue the driver. They may write asking who was driving. Part 8 of the Transport (Scotland) Act 2019 is intended to change this once fully in force, so this is a position worth rechecking rather than relying on indefinitely.

Northern Ireland differs again.

None of which is a strategy. It is a reason the same overstay produces different outcomes in different parts of Britain.

ANPR, and why "we bought something" rarely helps

Cameras read your plate in and out. The system does not know or care that you shopped. Some operators allow you to validate a longer stay in store — if that exists it will be advertised at the entrance, and if it is not advertised it does not exist.

A motorhome triggers cameras exactly like a car. Being obviously self-contained and parked tidily at the far end changes nothing.

The thing that does work: ask

A duty manager can authorise an overnight stay, and sometimes will — particularly at 24-hour stores, at quiet times, or if you are buying a proper shop. It costs a conversation.

Get it in a form you can point at. A name is better than a nod, and a note is better than a name. The person who authorised it will not be the person operating the camera system.

The honest summary

Supermarkets are a poor overnight option. They are lit, they are noisy early, deliveries start before you want them to, and the economics of ANPR mean the charge usually arrives.

They are an excellent daytime option for a shop and a break, which is what they are for.
